All such restaurants, carriers (including airlines), motels, hotels and other persons or suppliers providing services, programs, or accommodations are independent contractors.

California Seller of Travel
Hand Crafted Travel® LLC is a Registered California Seller of Travel under registration #2094789-40. Registration as a seller of travel does not constitute approval by the State of California. Hand Crafted Travel® LLC participates in the California Travel Consumer Restitution Fund (TCRF). California law requires certain sellers of travel to have a trust account or bond. Hand Crafted Travel® LLC deposits all consumer funds in a Client Trust Account until disbursement to the travel suppliers.

For residents of California: Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than $50 for transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRF within 12 months after the scheduled completion date of the travel. A claim must include sufficient documentation to prove your claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a TCRF claim. For non-residents of California: Transactions are not covered by the California Travel Consumer Restitution Fund.
Upon cancellation of the transportation or travel services, where the passenger is not at fault and has not canceled in violation of any terms and conditions previously disclosed and agreed to by the passenger, all sums paid to the seller of travel for services not provided will be promptly paid to the passenger, unless the passenger advises the seller of travel in writing, after cancellation. This provision does not apply where the seller of travel has remitted the payment to another registered wholesale seller of travel or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon transportation or service. In this situation, the seller of travel must provide the passenger with a written statement accompanied by bank records establishing the disbursement of the payment, and if disbursed to a wholesale seller of travel, proof of current registration of that wholesaler.

Arbitration
Any dispute concerning, relating, or referring to this contract, brochures, web information, or any other literature concerning services or products sold by Hand Crafted Travel shall be resolved exclusively by binding arbitration in Fresno, California, according to the then existing commercial rules of the American Arbitration Association. Such proceedings will be governed by substantive (but not procedural) California law excluding any application or consideration of the California Arbitration Act. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable.

We reserve the right at any time to change or otherwise modify the Agreement without prior notice, and your purchase of any products or services signifies your acceptance of the updated or modified Agreement.

Advertising Disclosure
Our website www.handcraftedtravel.com provides editorial web content that relates to travel products and services that Hand Crafted Travel® LLC may sell to consumers. We are also part of an affiliate sales network. This means that we may, on occasion, receive referral fees or commissions from the companies that manufacture or sell travel products you see on this site. This policy is valid from March 1, 2021.

The Agreement describes what you are legally entitled to expect from us when you book your Tour, in addition to important obligations you enter into as a tour participant (‘Traveler’) that affect your legal rights. It is of vital importance that you read The Agreement in its entirety. The lead traveler assumes the responsibility of sharing The Agreement with each traveler for whom they make a booking. Hand Crafted Travel is not responsible for any Traveler’s unawareness of the Terms and Conditions or any other provisions in The Agreement due to the failure of the lead traveler to share this information with all other travelers. If you have any questions about The Agreement you should contact us before making any booking.

What is included in your Hand Crafted Travel Guided Tour
Accommodations
Any hotels listed in the Tour itinerary are indicative of the types of hotels we’ll use, but are not guaranteed. If the listed hotel is unavailable, a comparable hotel will be substituted. Hotel classifications are based on Hand Crafted Travel’s own assessment and may not reflect opinions of other sources. Many of the hotels we use are small operations where each room is unique. No specific room can be guaranteed in advance. Rooms are assigned on a ‘run-of-the-house’ basis by hotel management upon check-in, and space is subject to availability within the contracted room category.

The price of your Tour is based on the shared occupancy of twin- or double-bedded rooms. ‘Double bed’ simply means that there is one large bed for two people – it does not indicate the size of the bed. European bed sizes are different than the sizes common in the US, but most ‘double beds’ are between a queen and king bed in size. If you are a single traveler we will charge you a single supplement, based on the difference in cost between one person in a single room versus two people sharing a double room. Our goal is not to make money on the single supplement, but also not to lose money – single rooms are typically 70% to 80% of the cost of a double, so the supplement can be quite high.

Meals
Continental breakfast will be provided each morning. Other meals are included where indicated in the itinerary. During included lunches and dinners, alcoholic beverages are the responsibility of the Tour participant.

Conveyances
Surface transportation for the group is included in the price of the Tour. Individual transportation to the Tour beginning point, from the Tour ending point, and during free time, is not included.

Admission
The Tour price includes admission to all scheduled group sights, museums, and other activities.

What is NOT included in your Tour
Tour prices do not include your airfare and related taxes to the Tour departure point and from the Tour ending point. Any air travel arranged for you by Hand Crafted Travel is subject to the terms and conditions of the air carrier, including the cancellation terms. Your Tour does not include any lunches, dinners, or other meals not specifically mentioned in the itinerary.

As a service, Hand Crafted Travel will make hotel reservations before or after your Tour on a space available basis upon request. These hotel charges will be added to your Tour cost. Personal expenses such as phone calls, room service, alcoholic and bar beverages, laundry, airline excess luggage charges, and other optional incidental extras are not included. This list is illustrative and not a complete list of every item not included.

Payment Schedule
A non-refundable deposit of 20% of the Tour cost is due at the time of booking. This forms a part of the final payment for the Tour. Final payment is due in our office not less than 60 days prior to departure. If final payment is not received by then, we reserve the right to treat your booking as canceled by you, in which case the charges set out below will become payable.

Cancellation
Cancellation date is the date we receive notice of a Traveler’s intent to cancel in written form. The following cancellation fees apply:

• More than 60 days before departure: Loss of deposit.
• 60 days or less before departure: 100% of total Tour price.

Luggage
Each Tour participant is limited to one carry-on sized bag (approximately 9”x 14”x 22”) plus a small tote bag or day pack (roughly 6”x 12”x 18”). This may be amended depending on the exact number of Tour participants, but if you plan to bring a larger bag you must verify the size with Hand Crafted Travel before bringing anything larger.
For private tours, these conditions may vary depending on the number of participants and individual arrangements made with Hand Crafted Travel.

Travel Documents
A valid passport is required for all participants. Note that many countries require your passport to be valid for at least six months beyond the date of your planned travel. If your passport is getting close to the expiration date, it’s best to apply for a new one now. It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, and any other requirements to be permitted entry into each destination. Your failure to have proper visas and/or passport will likely result in you not being able to leave a country or enter a destination and no refund will be available in any such case and Hand Crafted Travel will have no liability in such case.

Health and Safety
We have no special knowledge regarding foreign entry requirements, unsafe conditions, health hazards, weather hazards, supplier bankruptcies, or the suitability for disabled persons of any portion of any tour. For information about foreign health requirements and dangers visit to https://wwwnc.cdc.gov/travel. You hereby release us from any claims resulting in whole or in part from any problem covered in this paragraph and any other causes not within our control, and to submit all other claims against us within 30 days after the return of your trip.

You participate in the activities of the Tour at your own risk. Climbing, hiking, extensive walking, touring in general, use of various transportation and recreational vehicles, and other physical activity may involve greater risk of injury or death than the activities which you may participate in during your daily life. By taking part in such activities, you incur and assume all of the risks that such activities present. As Hand Crafted Travel is not qualified to evaluate your fitness, you (or your doctor) must evaluate your fitness for any given tour or activity. Hand Crafted Travel assumes no liability or responsibility for any Damages which may result from your participation in any activity during the Tour. You may be required to sign waivers on or before the departure date. Failure to sign waivers may prevent you from participating in the Tour or from participating in specific Tour activities.

Traveler Conduct
By participating in a Hand Crafted Travel Tour, a Traveler agrees to be bound by all rules and guidelines established by Hand Crafted Travel, its representatives, and guides. We reserve the right to decline to accept as a Traveler, or retain a person as a Traveler of a Tour. No refund can be made for any feature of a Tour not used by the Traveler. Hand Crafted Travel reserves the right to terminate your Tour if you are abusive of others, or your behavior disrupts the Tour or your physical condition negatively impacts the enjoyment of the other Travelers. Hand Crafted Travel will make no refund and will accept no liability if you must leave the Tour. Hand Crafted Travel is not responsible for any costs incurred by you due to removal from a Tour. When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us.

Traveling with Minors
The minimum age for all Travelers on Hand Crafted Travel’s regularly scheduled Tours is 18 years old. Minors are only accepted on private Tours. By allowing a minor to participate in a Hand Crafted Travel Tour, the parents and/or guardian of the participating minor agree to be solely responsible for the supervision and welfare of the minor on the Tour and to ensure that the minor follows all written and verbal rules of safety. The parents and/or guardian of the participating minor, for themselves and on behalf of the participating minor, hereby release and discharge, and agree to hold harmless, Hand Crafted Travel from and against any and all Damages (including, without limitation, emotional trauma) suffered or incurred by such minor.

If you are traveling as the guardian of a child/children, we strongly suggest that you carry a letter from both parents of the child authorizing emergency treatment in the event of illness or accident. For travel abroad, many foreign countries have specific entry requirements for children under 21 who are traveling internationally without BOTH parents. (These requirements are in response to the increased incidence of children being abducted and taken abroad.) Please note that Hand Crafted Travel is not responsible for the disruption of travel caused by improper documentation for children traveling without both parents.

Special Dietary Requests
The restaurants, hotels, caterers, and numerous other partners we work with all do their best to accommodate special dietary requests from you. However, given the diverse nature of those food providers (from small, family-run bistros to world-famous restaurants), some of our partners are better able than others to accommodate such requests. We therefore cannot guarantee that all dietary requests can be accommodated at every meal. Also, please note that where dietary requests can be accommodated, choices will frequently be limited.

Mobility Restrictions
Hand Crafted Travel regrets that it cannot provide special assistance for walking, wheelchairs, motorized scooters, dining or other personal needs unless the Traveler is participating in a private Tour. If you need such assistance, you must be accompanied by an able companion who will assist you.

Photos and Videos
Occasionally Hand Crafted Travel will use photographs and/or video taken on tour by fellow guests, your guide, or professional photographers for use in print, internet, and other promotional purposes. If you prefer that your image not be used in any marketing activities, please notify your guide at the start of your Tour.

Timing
All times listed in the itinerary are approximate and are subject to change to comply with up-to-date schedules.

If there is a change in plan
Occasionally it is necessary to change itinerary specifics. In the event that it becomes necessary or advisable for the well being of passengers, for any reason whatsoever, to alter the itinerary or arrangement, such alterations may be made without penalty to Hand Crafted Travel or its agents. Due to the vagaries of the travel industry, a scheduled visit to a manufacturer, museum, or other event is sometimes canceled. We cannot guarantee that any item or amenity mentioned will be available, especially where we have no control over it. Should it be necessary to change part of the itinerary we will make every effort to find a suitable replacement, but cannot be held financially responsible for a full or partial refund.

We reserve the right to withdraw or reschedule any and all Tours should conditions warrant. If we cancel, except in the case of extreme circumstances as detailed below, we will provide a full refund of all money paid for the Tour. You are responsible for any additional costs for air tickets, and travel arrangements not made by us.

Limit on Hand Crafted Travel’s Responsibilities
All Travelers on a Hand Crafted Travel Tour should be aware that, in arranging restaurants, transportation (including air transportation), motels, hotels and other accommodations or any other service, Hand Crafted Travel and its agents, employees, officers, directors, and affiliates are acting only as agent for the Traveler and assume no liability or responsibility for any accident, death, personal injury, illness, property damage, delay or other loss or expense of any nature whatsoever (collectively, “Damages”) arising directly or indirectly out of any act of God or any actions or omissions of, or default of, any restaurant, carrier (including airlines), motel, hotel, or other person or supplier of services providing any of the services, programs, or accommodations offered in connection with a Tour. All such restaurants, carriers (including airlines), motels, hotels and other persons or suppliers providing services, programs or accommodations are independent contractors.

By participating in a Tour, a Traveler agrees that Hand Crafted Travel shall not be liable or responsible for any Damages, or any problems concerning any restaurant, carrier (including airlines), motel, hotel, or other person or supplier providing services, programs, or accommodations, resulting directly or indirectly from any occurrences beyond the control of Hand Crafted Travel, including but not limited to acts of God, casualties, vehicle defects, natural disasters, labor disputes, theft, equipment breakdowns, cancellations of itinerary, delayed departures and arrivals, missed connections, quarantines, pilferage, weather, government restraints, hijackings, mechanical defects or failures, terrorist acts, or defaults or negligence by any restaurant, carrier (including airlines), motel, hotel or other supplier providing tour services, programs or accommodations. By participating in a Tour, a Traveler further agrees that Hand Crafted Travel shall not be liable or responsible for any Damages arising out of or relating to any Tour, except to the extent arising out of Hand Crafted Travel’s gross negligence or willful misconduct.

Extreme Circumstances
Hand Crafted Travel assumes no liability for any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other Force Majeure condition, including, without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Hand Crafted Travel that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the event that any of these conditions apply, Hand Crafted Travel shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind including liability to make any refund. However, in a Force Majeure occurrence, Hand Crafted Travel reserves the right to issue a credit to you in lieu of a money-back refund, applicable to a future Hand Crafted Travel Tour.

Arbitration

You acknowledge and agree that we may change these Terms and Conditions from time to time and that those changes become effective immediately. If we make material changes, we will provide you notice. Your continued use of our services following the notice of any changes constitutes your acceptance and agreement to be bound by such changes. You agree to be bound by the Terms and Conditions that are in effect at the time of travel or cancellation.

Corrections
Hand Crafted Travel reserves the right to correct any errors or omissions in its published materials and to amend these Tour Terms and Conditions at any time as the result of any material changes to legislation or regulation. All amended Tour Terms and Conditions shall automatically be effective upon being posted by Hand Crafted Travel to the website handcraftedtravel.com. Accordingly, guests should check the website handcraftedtravel.com prior to travel in order to ensure they are aware of any changes.

Release
In consideration of the services and arrangements provided by Hand Crafted Travel, you, for yourself and for your heirs, personal representatives or assigns, do hereby release, waive, discharge, hold harmless and agree to indemnify Hand Crafted Travel, and its owners, officers, directors, employees, contractors, subcontractors, and affiliates from any and all claims, actions, or losses for emotional injury, bodily injury, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur during your travel in connection therewith.

Payment Schedule
Hand Crafted Travel’s ‘Custom’ Trip Plans include a pre-planned, land-only itinerary. Unless otherwise indicated, Custom Trip Plans also include pre-paid hotels, train tickets, rental cars, museum tickets (wherever possible), and/or other pre-paid travel experiences as described in each package.

Before beginning work on your Custom Trip Plan we require a non-refundable Planning Fee according to the following schedule:

• Trip Length 1 - 3 days: $400
• Trip Length 4 - 7 days: $600
• Trip Length 8 - 15 days: $800
• Trip Length 16 - 23 days: $1000
• Trip Length 24+ days: $45 per day

Once we have agreed on the final Custom Trip Plan, an additional non-refundable deposit will be required. The amount of the additional deposit will depend on the total cost of the services quoted and may vary based on the terms imposed by our partners and service suppliers. Once confirmed, the non-refundable deposit is applied to the invoice with the remaining balance due 90 days prior to departure. For reservations within 90 days of departure payment of the total package price is required in order to confirm services.

Confirmation of Services
Hotel accommodations and other services are confirmed upon receipt of a non-refundable deposit. Hotel confirmations may take 72 hours to receive a response. If the requested hotel cannot be confirmed, a comparable (in price and standard) alternate hotel will be confirmed.

Timing of confirmation varies for all other services (sightseeing, transfers, rail, car rental, etc). In the event one of these services is not available, or the price has changed, we will do our best to reserve a suitable alternative and you will be notified of the change. Cancellation fees still apply.

Once confirmed, all changes are subject to a $100 change fee. Each change made to a reservation after documents are issued will incur a $200 change fee plus any applicable airline and/or supplier fees. Cancellations within 60 days of the trip start date are non-refundable.

Cancellation
Cancellation date is the date we receive notice of a Traveler’s intent to cancel in written form. The following cancellation fees apply:

• More than 60 days before departure: Loss of deposit.
• 60 days or less before departure: 100% of total Trip price.

What is included in your Custom Trip Plan
Hotels
Hotel classifications are based on Hand Crafted Travel’s own assessment and may not reflect opinions of other sources. Many of the hotels we use are small operations where each room is unique. No specific room can be guaranteed in advance. Rooms are assigned on a ‘run-of-the-house’ basis by hotel management upon check-in, and space is subject to availability within the contracted room category.

The price of your Custom Trip Plan is based on the shared occupancy of twin- or double-bedded rooms. ‘Double bed’ simply means that there is one large bed for two people – it does not indicate the size of the bed. European bed sizes are different than the sizes common in the US, but most ‘double beds’ are between a queen and king bed in size.

Meals
Continental breakfast will be provided in the hotel each morning, unless otherwise indicated in the itinerary (in which case it will be an option that can be purchased from the hotel locally). Other meals are only included where indicated in the itinerary.

Car Rentals
Any car rental included with your Custom Trip Plan is for a contracted car rental category. Any make or model indicated on the voucher is merely an example of the type of car in the category, and not a guarantee of the make or model you will receive.

The minimum age for drivers is 21 years old and is subject to car rental company rules. Some countries and rental companies also impose a maximum age, ranging from 70 years old and up. If you will be over 70 years old when travel begins, please contact us to confirm details on rental car pricing.

Unless indicated, rates include unlimited mileage and Value Added Tax (VAT). Collision Damage Waiver (CDW) is mandatory in certain countries, and in such cases is included in the quoted price. In countries where CDW is optional, CDW may be purchased for an additional charge.

Unless otherwise stated on the rental agreement, airport surcharges, and regional road taxes are not included in the quoted price and are payable locally.

For legal reasons rental car reservations must be charged to the primary driver's credit card. The amount of the rental will be deducted from the advertised cost of the Custom Trip Plan package, and your final invoice will reflect this deduction.

Train Tickets
A variety of train tickets may be included with your Custom Trip Plan. These can include First Class point-to-point tickets; Second Class point-to-point tickets; tickets for scenic journeys or other special trains; and/or rail passes. Hand Crafted Travel issues seat reservations wherever required for use of train services, and may also reserve seats where not required if we feel seat reservations are advisable. Details on using these tickets and/or passes will be included in the daily itinerary portion of your Custom Trip Plan.

Many point-to-point tickets and all seat reservations are valid only on a specific train, for a specified date and time. Hand Crafted Travel is not liable or responsible for any costs incurred due to missed trains, schedule changes, delays, missed connections, and/or cancellations.

Local Conveyances and other transport services
Unless explicitly indicated, local conveyances, such as transportation by taxi, subway, or bus, are not included in the cost of your Custom Trip Plan. Your Custom Trip Plan may include airport transfers, tickets for ferries, boats, ships, and/or other local conveyances. Details on using these tickets will be included in the daily itinerary portion of your Custom Trip Plan.

Admission tickets and other travel experiences
Whenever possible and/or advisable, Hand Crafted Travel will reserve ‘skip-the-line’ entry tickets to museums. Your Custom Trip Plan may also include reservations with local guides or other travel experiences. These reservations are for a specific location, date, and time. Hand Crafted Travel is not liable or responsible for any costs incurred by the Traveler’s failure to keep the scheduled time for any sights, museums, and/or other activities.

What is NOT included in your Custom Trip Plan
Custom Trip Plans do not include your airfare and related taxes to the departure point and from the ending point of your Trip. Any air travel arranged for you by Hand Crafted Travel is subject to the terms and conditions of the air carrier, including the cancellation terms. Your Trip does not include any lunches, dinners, or other meals not specifically mentioned in the itinerary.

As a service, Hand Crafted Travel will make hotel reservations before or after your Trip on a space available basis upon request. These hotel charges will be added to your Trip cost. Personal expenses such as phone calls, room service, alcoholic and bar beverages, laundry, airline excess luggage charges, and other optional incidental extras are not included. This list is illustrative and not a complete list of every item not included.

Luggage
Each Traveler is responsible for handling their own luggage. While carrying luggage Travelers may encounter hotels, train stations, and other locations with stairs and no elevators or escalators. Hand Crafted Travel highly encourages Travelers to pack as light as possible, and to limit themselves to one suitcase that they can easily manage themselves.

Travel Documents
A valid passport is required for all Travelers. Note that many countries require your passport to be valid for at least six months beyond the date of your planned travel. If your passport is getting close to the expiration date, it’s best to apply for a new one now. It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, and any other requirements to be permitted entry into each destination. Your failure to have proper visas and/or passport will likely result in you not being able to leave a country or enter a destination and no refund will be available in any such case and Hand Crafted Travel will have no liability in such case.

Health and Safety
All Travelers are required to confirm they are fully vaccinated, and/or have received a negative COVID-19 test within 72 hours of departing for your trip. Due to the COVID-19 pandemic, some destinations may have specific requirements including but not limited to proof of a negative COVID-19 test, a vaccination, and health insurance. These guidelines are in addition to, and may go beyond, Hand Crafted Travel’s requirements. It is your sole responsibility to understand the requirements specific to your travel destination(s). In addition, Hand Crafted Travel reserves the right to require additional documentation in order to participate on a tour or cruise, in which case you will be informed of the requirements ahead of your trip.

You participate in the activities of any Hand Crafted Trip at your own risk. Climbing, hiking, extensive walking, touring in general, use of various transportation and recreational vehicles, and other physical activity may involve greater risk of injury or death than the activities which you may participate in during your daily life. By taking part in such activities, you incur and assume all of the risks that such activities present. As Hand Crafted Travel is not qualified to evaluate your fitness, you (or your doctor) must evaluate your fitness for any given tour or activity. Hand Crafted Travel assumes no liability or responsibility for any Damages which may result from your participation in any activity during the Trip. You may be required to sign waivers on or before the departure date, or before participating in certain activities. Failure to sign waivers may prevent you from participating in specific Trip activities.

Traveling with Minors
If you are traveling as the guardian of a child/children, we strongly suggest that you carry a letter from both parents of the child authorizing emergency treatment in the event of illness or accident. For travel abroad, many foreign countries have specific entry requirements for children under 21 who are traveling internationally without BOTH parents. (These requirements are in response to the increased incidence of children being abducted and taken abroad.) Please note that Hand Crafted Travel is not responsible for the disruption of travel caused by improper documentation for children traveling without both parents.

Special Dietary Requests
The restaurants, hotels, caterers, and numerous other partners we work with all do their best to accommodate special dietary requests from you. However, given the diverse nature of those food providers (from small, family-run bistros to world-famous restaurants), some of our partners are better able than others to accommodate such requests. We therefore cannot guarantee that all dietary requests can be accommodated at every meal. Also, please note that where dietary requests can be accommodated, choices will frequently be limited.

Timing
All times listed in the Trip Plan are approximate and are subject to change to comply with up-to-date schedules. Hand Crafted Travel recommends that you always confirm times locally.

If there is a change in plan
Occasionally it is necessary to change itinerary specifics. Due to the vagaries of the travel industry, a scheduled visit to a manufacturer, museum, or other event is sometimes canceled. We cannot guarantee that any item or amenity mentioned will be available, especially where we have no control over it. Should it be necessary to change part of the itinerary we will make every effort to find a suitable replacement, but cannot be held financially responsible for a full or partial refund.

Limit on Hand Crafted Travel’s Responsibilities
All Travelers on a Hand Crafted Travel Trip should be aware that, in arranging restaurants, transportation (including air transportation), motels, hotels and other accommodations or any other service, Hand Crafted Travel and its agents, employees, officers, directors, and affiliates are acting only as agent for the Traveler. By participating in a Trip, a Traveler agrees that Hand Crafted Travel shall not be liable or responsible for any Damages, or any problems concerning any restaurant, carrier (including airlines), motel, hotel, or other person or supplier providing services, programs, or accommodations, resulting directly or indirectly from any occurrences beyond the control of Hand Crafted Travel, including but not limited to acts of God, casualties, vehicle defects, natural disasters, labor disputes, theft, equipment breakdowns, cancellations of itinerary, delayed departures and arrivals, missed connections, quarantines, pilferage, weather, government restraints, hijackings, mechanical defects or failures, terrorist acts, or defaults or negligence by any restaurant, carrier (including airlines), motel, hotel or other supplier providing tour services, programs or accommodations. By participating in a Trip, a Traveler further agrees that Hand Crafted Travel shall not be liable or responsible for any Damages arising out of or relating to any Trip, except to the extent arising out of Hand Crafted Travel’s gross negligence or willful misconduct.

Extreme Circumstances
Hand Crafted Travel assumes no liability for any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other Force Majeure condition, including, without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Hand Crafted Travel that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the event that any of these conditions apply, Hand Crafted Travel shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind including liability to make any refund. However, in a Force Majeure occurrence, Hand Crafted Travel reserves the right to issue a credit to you in lieu of a money-back refund, applicable to a future Hand Crafted Travel Trip.

Hand Crafted Travel reserves the right to correct any errors or omissions in its published materials and to amend these Tour Terms and Conditions at any time as the result of any material changes to legislation or regulation. All amended Tour Terms and Conditions shall automatically be effective upon being posted by Hand Crafted Travel to the website handcraftedtravel.com. Accordingly, guests should check the website handcraftedtravel.com prior to travel in order to ensure they are aware of any changes.

Any dispute concerning, relating, or referring to this contract, brochures, web information, or any other literature concerning a Hand Crafted Trip shall be resolved exclusively by binding arbitration in Fresno, California, according to the then existing commercial rules of the American Arbitration Association. Such proceedings will be governed by substantive (but not procedural) California law excluding any application or consideration of the California Arbitration Act. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable.

You acknowledge and agree that we may change these Terms and Conditions from time to time and that those changes become effective immediately. If we make material changes, we will provide you notice. Your continued use of our services following the notice of any changes constitutes your acceptance and agreement to be bound by such changes. You agree to be bound by the Terms and Conditions that are in effect at the time of travel or cancellation.

Hand Crafted Travel® LLC is a Registered California Seller of Travel under registration #2094789-40. Registration as a seller of travel does not constitute approval by the State of California. Hand Crafted Travel LLC participates in the California Travel Consumer Restitution Fund (TCRF). California law requires certain sellers of travel to have a trust account or bond. Hand Crafted Travel® LLC deposits all consumer funds in a Client Trust Account until disbursement to the travel suppliers.

For residents of California: Eligible passengers may file a claim with TCRF if the passenger is owed a refund of more than $50 for transportation or travel services which the seller of travel failed to forward to a proper provider or such money was not refunded to you when required. The maximum amount which may be paid by the TCRF to any one passenger is the total amount paid on behalf of the passenger to the seller of travel, not to exceed $15,000. A claim must be submitted to the TCRF within 12 months after the scheduled completion date of the travel. A claim must include sufficient documentation to prove your claim and a $35 processing fee. Claimants must agree to waive their right to other civil remedies against a registered participating seller of travel for matters arising out of a sale for which you file a TCRF claim. You may request a claim form by writing to: Travel Consumer Restitution Corporation, P.O. Box 6001, Larkspur, CA 94977-6001; or by visiting TCRC’s website at: www.tcrcinfo.org.

For non-residents of California: Transactions are not covered by the California Travel Consumer Restitution Fund.
Upon cancellation of the transportation or travel services, where the passenger is not at fault and has not canceled in violation of any terms and conditions previously disclosed and agreed to by the passenger, all sums paid to the seller of travel for services not provided will be promptly paid to the passenger, unless the passenger advises the seller of travel in writing, after cancellation. This provision does not apply where the seller of travel has remitted the payment to another registered wholesale seller of travel or a carrier, without obtaining a refund, and where the wholesaler or provider defaults in providing the agreed-upon transportation or service. In this situation, the seller of travel must provide the passenger with a written statement accompanied by bank records establishing the disbursement of the payment, and if disbursed to a wholesale seller of travel, proof of current registration of that wholesaler.
